August 15, 2011 - Bankruptcy Court Authority Under Stern V. Marshall

The United States Supreme Court recently considered the scope of the authority that bankruptcy judges possess under 28 U.S.C. § 157 and Articles I and III of the Constitution in Stern v. Marshall. In its 5-4 decision, the Supreme Court ruled that a bankruptcy court lacked constitutional authority to issue a final judgment on a counterclaim based upon state law. .....continued

July 2011 - Okin Adams & Kilmer LLP is pleased to announce that Brian Kilmer was recently admitted to practice in all of the Federal District Courts of Louisiana, which include the Western, Middle and Eastern Districts.

Mr. Kilmer has been licensed to practice in Louisiana and Texas since 1999. His practice focuses on representing debtors, unsecured creditors' committees and secured creditors in complex Chapter 11 cases and out-of-court workouts. Additionally, Mr. Kilmer has extensive experience with general business litigation matters.
